Cookie Policy

Section 2 of Article 22 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, LSSI-CE), establishes the following:

Service providers may use data storage and retrieval devices on the terminal equipment of the recipients, provided that they have given their consent after being provided with clear and complete information about their use, in particular regarding the purposes of data processing, in accordance with Organic Law 15/1999, of December 13, on the Protection of Personal Data.

Where technically possible and effective, the recipient’s consent to accept data processing may be provided through the use of appropriate browser settings or other applications, provided that the recipient configures them during installation or update through an express action for that purpose.

The above does not prevent possible technical storage or access solely for the purpose of transmitting a communication over an electronic communications network or, to the extent strictly necessary, for the provision of an information society service expressly requested by the recipient.

According to the “Guide on the Use of Cookies,” published by the Spanish Data Protection Agency (hereinafter, AEPD) in 2013, the LSSI-CE applies to any type of file or device downloaded to a user’s terminal equipment to store data that can be updated and retrieved by the entity responsible for its installation. Cookies are one of these widely used devices; hereinafter, these devices will be referred to generically as cookies.

Cookies exempt from compliance with the obligations established in Article 22.2 of the LSSI-CE include those used for the following purposes:

  • To allow communication between the user’s device and the network only.

  • Strictly to provide a service expressly requested by the user.


TYPES OF COOKIES BY PURPOSE

A cookie is a file downloaded to your computer when accessing certain websites. Cookies allow a website, among other things, to store and retrieve information about a user’s browsing habits or their device and, depending on the information they contain and how your device is used, may be used to recognize the user.

As indicated in the AEPD’s “Guide on the Use of Cookies,” depending on the purpose for which the data obtained through cookies is processed, we can distinguish between:

  • Technical cookies: These allow the user to navigate a website, platform, or application and use the different options or services available, such as controlling traffic and data communication, identifying the session, accessing restricted areas, remembering items in an order, completing a purchase, registering for an event, using security elements during navigation, storing content for video or audio playback, or sharing content via social networks.

  • Personalization cookies: These allow the user to access the service with certain pre-defined general characteristics based on criteria on the user’s device, such as language, browser type, or regional settings.

  • Analytics cookies: These allow the owner to track and analyze user behavior on the websites to which they are linked. The information collected is used to measure site, app, or platform activity and to create user browsing profiles to introduce improvements based on usage data.

  • Advertising cookies: These allow the effective management of advertising spaces included by the publisher on a website, application, or platform from which the requested service is provided, based on criteria such as content or ad frequency.

  • Behavioral advertising cookies: These allow the management of advertising spaces as efficiently as possible, storing information on user behavior obtained through continuous observation of browsing habits, enabling the development of specific profiles to display ads accordingly.

  • Third-party cookies: This website may use third-party services that, on behalf of the company, collect information for statistical purposes, site usage, or other Internet services related to the activity of the website.


COOKIE INTRUSIVENESS LEVELS AND DEACTIVATION

Cookies can be categorized into three levels of intrusiveness:

  • Level 1: Essential internal cookies required for the provision of the requested service.

  • Level 2: Anonymous internal cookies necessary for content and navigation maintenance, as well as cookies managed by third parties within the framework of services expressly requested by the user (e.g., Facebook or Twitter Social Plugins).
